After a brewery backlash against the FDA’s proposed rules that would restrict (by heavy regulation) breweries from providing grain to farms for livestock feed, the FDA changed its tune. The primary concern of the FDA now appears to be how the spent grain is held at the brewery and transported to the farm, the American Malting Barley Association told its members. Thus, rather than facing heavy regulation that may have required drying and packaging spent grain, the FDA may be leaning towards lighter regulation that focuses on documenting the cleanliness of the silos that store the grains and the trucks that bring them to the farms. Until the new regulations are released this summer, however, brewers remain wary given the current state of uncertainty.
